Terms and Conditions

1. Introduction

Welcome to SOSquat ("Platform", "Service", "we", "us", or "our"). SOSquat is a property discovery platform operated by Hatchify Pty Ltd (ABN 87 600 809 167), a company registered in New South Wales, Australia, with its principal place of business in Sydney, Australia.

By accessing or using our Platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the Platform, including property agents ("Agents"), consumers ("Users"), and visitors.

2. Definitions

• "PIN" means a property listing marker placed on the SOSquat map by an Agent.
• "PIN Token" means a digital credit used to maintain active PINs beyond the free quota.
• "Agent" means a registered real estate agent or property professional using the Platform.
• "User" means any person accessing or using the Platform.
• "Content" means any information, data, text, images, or other materials uploaded to the Platform.

3. Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. Agents must hold valid real estate licenses or certifications as required by their jurisdiction.

4. Service Description

SOSquat provides a map-based property discovery platform that allows:

• Agents to create and manage property PINs on an interactive map
• Users to discover and view property listings
• Integration with external property listing websites
• Communication between Agents and potential clients

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

5. PIN Tokens and Pricing

5.1 Free Quota

Each Agent account includes a free quota of five (5) active PINs at no charge. PINs within the free quota remain active indefinitely, subject to these Terms.

5.2 PIN Tokens

To maintain more than 5 active PINs, Agents must purchase PIN Tokens:

• PIN Tokens are sold in blocks of 10 tokens
• Price: RM 1.00 per token (RM 10.00 per block of 10)
• Each active PIN beyond the free quota consumes 1 token per month
• Tokens are consumed at the beginning of each billing cycle
• Unused tokens roll over to subsequent months

5.3 Insufficient Tokens

If an Agent has insufficient tokens to cover their active PINs beyond the free quota:

• Excess PINs will be automatically paused (oldest first)
• Paused PINs will not appear on the public map
• PINs can be reactivated once sufficient tokens are purchased

5.4 Payment Processing

All payments are processed securely through Stripe. We accept major credit cards, FPX (Malaysia), and GrabPay. By making a purchase, you agree to Stripe's terms of service. All prices are in Malaysian Ringgit (MYR) unless otherwise stated.

5.5 Refunds

PIN Tokens are non-refundable once purchased, except where required by applicable consumer protection laws. If you believe you are entitled to a refund, please contact us at support@sosquat.com.

6. User Conduct

You agree not to:

• Post false, misleading, or fraudulent property information
• Impersonate any person or entity
• Use the Platform for any unlawful purpose
• Interfere with or disrupt the Platform or servers
• Attempt to gain unauthorized access to any part of the Platform
• Scrape, harvest, or collect data from the Platform without permission
• Upload malicious code or content
• Violate any applicable laws or regulations

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of Content you upload to the Platform. By uploading Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content in connection with the Service.

7.2 Our Content

The Platform, including its design, features, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

8. Third-Party Links and Content

The Platform may contain links to third-party websites and property listings. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Platform will be uninterrupted or error-free
• Property information is accurate, complete, or current
• The Platform will meet your specific requirements
• Any defects will be corrected

We do not verify property listings or Agent credentials. Users should conduct their own due diligence before making any property decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HATCHIFY PTY LTD AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Hatchify Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:

• Your right to use the Platform ceases immediately
• Your PINs will be removed from the map
• Unused PIN Tokens are non-refundable
• We may delete your account data after a reasonable period

13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
